Did you know that in the Dominican Republic, mere possession of land does not yet guarantee full rights to it? The Deslinde procedure is the ultimate confirmation of a plot’s boundaries and ownership – essential for the property to be legally secured and available for further transactions.

What is Deslinde?

Deslinde is a legal and administrative procedure aimed at delineating and officially confirming property boundaries. As a result, the owner receives an individual Certificate of Title (Certificado de Título). The process involves surveying the plot using geodesic works, which formally separate it from neighboring areas. Deslinde is essential for legal security – it protects against illegal land occupation and forms the basis for further transactions, such as sale or inheritance.

It is definitely worth performing Deslinde – only then does the Dominican state guarantee protection against illegal occupation of the plot, for example, by so-called squatters, i.e., individuals who occupy someone else’s property without the owner’s consent. A plot with a valid Deslinde also has a higher market value, making it easier to sell, bequeath, or use as collateral for investments. This is a necessary condition for a property to legally function in legal circulation. The question, therefore, is not “whether,” but how to go through this procedure.

All Stages of the Deslinde Procedure

The procedure consists of three stages: technical, judicial, and registration. As the names suggest – first, a surveyor performs measurements, which are then reviewed by a court, so that finally, officials can issue the appropriate statement.

1. Technical Stage

The first step is to perform geodesic measurements by an authorized surveyor (agrimensor). At this stage, it is also necessary to:

  • publish an announcement of the survey in local and national newspapers;
  • officially notify neighbors and all interested parties about the planned works.

This is partly due to Resolution 790/2022, which we will discuss in more detail later.

2. Judicial Stage

After the measurements are completed, the case goes to the Land Court (Tribunal de Tierras). The court conducts a hearing during which any claims, ambiguities, or objections are analyzed. If there are no obstacles, the court issues a judgment that approves the Deslinde result and confirms the property boundaries.

3. Registration Stage

After the court judgment is issued, the final stage follows – registration of the property with the property registration office. The owner then receives a new Certificado de Título, in which the plot boundaries are precisely defined and legally confirmed. The entire procedure takes from several months to over a year – depending on the complexity of the case… and, of course, the pace of work of the Dominican authorities, who are not exactly known for their speed.

New Regulations Regarding Deslinde (Resolution 790/2022)

In October 2022, Resolution 790/2022 came into force, which tightens and formalizes the Deslinde procedure. The new regulations introduce the obligation to publish announcements in both local and national newspapers – at both the technical and judicial stages. As if that weren’t enough, the property owner must also notify all neighbors, potential creditors, and public authorities – e.g., the Ministry of Environment, if the plot borders protected areas – about the procedure.

Another change involves more detailed requirements for the announcement of the court hearing. Information about the hearing date must now be physically posted, among other places, on the doors of the local justice of the peace court and in administrative offices, which aims to ensure transparency and the possibility for interested parties to raise objections. In theory, the new regulations increase security, but in practice, they also extend the waiting time and increase the costs of the procedure. Therefore, it is advisable to consult a lawyer who is proficient in Deslinde to estimate the costs in your specific case.

Don’t know where to start?

The Deslinde procedure is initiated by the property owner contacting a certified surveyor (agrimensor) who holds qualifications issued by the Dirección Regional de Mensuras. It is the surveyor who performs the measurements at the technical stage and is responsible for preparing the field documentation.
