NEWSLETTER TERMS AND CONDITIONS

§ 1. General Provisions

  1. These Terms and Conditions define the rules for the provision of the newsletter service by Casa Dominicana Ltd. with its registered office in Warsaw (ul. Prosta 70, 00-838 Warsaw), entered into the register of entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register under KRS number 0000890333, NIP 7011025906, REGON 388469220 (hereinafter: “Service Provider” or “Administrator”).
  2. The newsletter service consists of the free, periodic electronic transmission by the Service Provider (to the e-mail address provided by the Subscriber) of information regarding real estate offers in the Dominican Republic, market news, educational materials, and marketing content (hereinafter: “Newsletter”).
  3. Newsletter subscription is voluntary and free of charge.
  4. To use the Newsletter, an active e-mail address is required.

§ 2. Definitions

For the purposes of these Terms and Conditions, the following definitions are adopted:

  • Subscriber – a natural person, legal person, or organizational unit that has voluntarily subscribed to the Newsletter via the subscription form available on the website https://www.casa-dominicana.com;
  • Newsletter – a service provided electronically, consisting of sending e-mail messages to the Subscriber containing informational, marketing, and promotional content;
  • Subscription Form – an interactive form available on the Website, enabling subscription to the Newsletter;
  • Website – the website available at https://www.casa-dominicana.com.

§ 3. Newsletter Subscription Conditions

  1. Subscription to the Newsletter occurs by:
  • entering an e-mail address in the subscription form located on the Website,
  • checking the checkbox confirming acquaintance with these Terms and Conditions and expressing consent to receive the Newsletter,
  • clicking the “Subscribe” button or its equivalent,
  • clicking the activation link sent to the provided e-mail address (double opt-in).
  1. Newsletter subscription requires providing only the Subscriber’s e-mail address. Providing other data (e.g., name) is voluntary and serves to personalize content.
  2. The Subscriber should provide their own active e-mail address. It is not permissible to provide third-party e-mail addresses without their consent.
  3. The Service Provider uses a subscription confirmation mechanism (double opt-in): after entering the e-mail address, the Subscriber receives a message with a confirmation link. The subscription is active only after clicking the link. The Service Provider stores proof of consent (timestamp, IP address, form version) for the entire subscription period and 3 years after its termination.

§ 4. Newsletter Content

The Newsletter may contain, in particular:

  • information about available real estate offers in the Dominican Republic (Punta Cana, Bávaro, Bayahibe, and other locations),
  • analyses and news of the real estate market in the Dominican Republic,
  • information about events, webinars, and meetings organized by the Service Provider,
  • educational materials regarding the process of purchasing real estate abroad,
  • content of a marketing and promotional nature.

§ 5. Consent to Newsletter – checkbox content and declarations

Next to the Newsletter subscription form, the following statement is placed, which the Subscriber confirms by checking the checkbox:

[ ] I consent to Casa Dominicana Ltd. sending me commercial information regarding real estate in the Dominican Republic and marketing materials electronically to the provided e-mail address, in accordance with Article 10 of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2020, item 344, as amended). I have read the Newsletter Terms and Conditions and the Privacy Policy. I understand that I can withdraw my consent at any time without giving a reason.

The above consent is required. Failure to grant it prevents subscription to the Newsletter.

§ 6. Proof of Consent

  1. The Service Provider collects and stores proof of consent for Newsletter subscription, which includes:
  • the Subscriber’s e-mail address,
  • date and time of subscription (timestamp),
  • IP address of the device from which the subscription was made,
  • version of the subscription form (version number, page URL),
  • content of the checked consent checkbox at the time of subscription,
  • date and time of clicking the confirmation link (double opt-in).
  1. The above data is stored for the entire subscription period and for 3 years from the date of unsubscribing.
  2. In case of a need to demonstrate the fact and scope of consent (e.g., at the request of a supervisory authority), the Service Provider is able to reconstruct the full history of the Subscriber’s consent.

§ 7. Unsubscribing from the Newsletter

  1. The Subscriber may at any time, without giving a reason and free of charge, unsubscribe from the Newsletter by:
  • clicking the “Unsubscribe” link located in the footer of each Newsletter message;
  • sending an e-mail to: andrzej@casa-dominicana.com with information about unsubscribing;
  • contacting by phone at: +48 782 942 023.
  1. Unsubscribing from the subscription is effective immediately, but no later than within 10 business days of its receipt.
  2. Unsubscribing from the Newsletter is not equivalent to unsubscribing from other services of the Website.

§ 8. Processing of personal data within the Newsletter

  1. The administrator of Subscribers’ personal data is Casa Dominicana Ltd. with its registered office in Warsaw, ul. Prosta 70, 00-838 Warsaw.
  2. Subscribers’ personal data (e-mail address, optionally name) are processed for the purpose of: a) providing the Newsletter service – legal basis: Article 6(1)(a) of the GDPR (Subscriber’s consent), b) demonstrating the granted consent and its scope – legal basis: Article 6(1)(c) of the GDPR (legal obligation), c) pursuing the legitimate interest of the Administrator consisting of establishing, pursuing, or defending claims – legal basis: Article 6(1)(f) of the GDPR.
  3. Providing an e-mail address is necessary for the provision of the Newsletter service. Failure to provide data makes subscription impossible.
  4. Personal data is stored for the duration of the subscription and 3 years after its termination.
  5. The Subscriber has the right to: access their data, rectify it, erase it, restrict its processing, data portability, and object to processing. They also have the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw, uodo.gov.pl).
  6. Detailed information regarding the processing of personal data is contained in the Privacy Policy available on the Website.

§ 9. Complaints

  1. All complaints regarding the Newsletter service should be sent to the e-mail address: andrzej@casa-dominicana.com or in writing to: Casa Dominicana Ltd., ul. Prosta 70, 00-838 Warsaw.
  2. A complaint should contain: data identifying the Subscriber, a description of the subject of the complaint, and the Subscriber’s request.
  3. The Service Provider shall consider the complaint within 14 days of its receipt and inform the Subscriber about the resolution.

§ 10. Final Provisions

  1. These Terms and Conditions come into force on June 1, 2026.
  2. The Service Provider reserves the right to amend the Terms and Conditions. Subscribers will be informed of each change at least 14 days in advance via e-mail. Failure to unsubscribe within this period is equivalent to accepting the new terms.
  3. In matters not regulated by these Terms and Conditions, Polish law shall apply, in particular: the Act of July 18, 2002, on the provision of electronic services, Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), and the Act of July 16, 2004, Telecommunications Law.
