TERMS AND CONDITIONS FOR THE PROVISION OF ELECTRONIC SERVICES

These Terms and Conditions define the rules for the provision of electronic services by Casa Dominicana sp. z o.o. through the website https://www.casa-dominicana.com, in accordance with the requirements of the Act of July 18, 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2020, item 344, as amended).

 

§ 1. Service Provider Information

§ 2. Definitions

The terms used in these Terms and Conditions mean:

  • Service Provider – Casa Dominicana sp. z o.o.;
  • Service Recipient – any natural person, legal person, or organizational unit without legal personality using the Website;
  • Website – the website available at https://www.casa-dominicana.com;
  • Electronic Service – a service provided without the simultaneous presence of the parties, via a telecommunications network, at the individual request of the Service Recipient;
  • Terms and Conditions – this document.

 

§ 3. Types and Scope of Electronic Services

Through the Website, the Service Provider provides the following electronic services:

  1. Browsing Website Content – a free service provided from the moment of entering the website until leaving it.
  2. Contact Form – enables sending an inquiry or message to the Service Provider electronically.
  3. Offer Inquiry Form – enables sending an inquiry regarding a specific property or scope of services.
  4. Newsletter – periodic sending of information about property offers and marketing materials to the Service Recipient’s e-mail address (based on separate Newsletter Terms and Conditions).
  5. Investment Consultation – the possibility of scheduling a consultation regarding property purchase in the Dominican Republic (format: video, phone, or in-person meeting).

§ 4. Technical Requirements

To use the Website and its functionalities, the following are required:

  • a device with Internet access (computer, smartphone, tablet),
  • a current version of a web browser (Chrome, Firefox, Edge, Safari) with JavaScript and cookies support,
  • an active e-mail account – when using forms and the Newsletter.

The Service Provider is not liable for technical problems resulting from the Service Recipient’s failure to meet the above requirements.

 

§ 5. Prohibition of Providing Unlawful Content

The Service Recipient is obliged to use the Website in accordance with the law and good practices. It is prohibited to provide through the Website content that:

  • violates legal provisions or the rights of third parties,
  • is unlawful, offensive, defamatory, or violates personal rights,
  • constitutes spam or unsolicited commercial correspondence,
  • contains viruses or malicious software.

The Service Provider reserves the right to remove unlawful content without prior notice.

 

§ 6. Terms of Concluding and Terminating Agreements

  1. An agreement for the provision of an electronic service is concluded:
  • in the case of browsing content – upon entering the Website,
  • in the case of contact forms – upon submitting the form,
  • in the case of the Newsletter – upon activation of the subscription (clicking the confirmation link).
  1. The agreement is terminated:
  • in the case of browsing content – upon leaving the website,
  • in the case of forms – upon completion of the inquiry handling,
  • in the case of the Newsletter – upon unsubscribing.
  1. A Service Recipient who is a consumer may withdraw from the agreement for the provision of electronic services within 14 days of its conclusion, without stating a reason (if consumer rights provisions apply).

 

§ 7. Complaint Procedure

  1. Complaints regarding electronic services should be directed to the e-mail address: info@casa-dominicana.com or in writing to the address: Casa Dominicana sp. z o.o., ul. Prosta 70, 00-838 Warsaw.
  2. The complaint should include: the Service Recipient’s contact details, description of the subject of the complaint, date and circumstances of the event, the Service Recipient’s request.
  3. The Service Provider will process the complaint within 14 calendar days of receiving it and will inform the Service Recipient of the outcome at the indicated e-mail or postal address.
  4. A Service Recipient who is a consumer has the right to use out-of-court complaint resolution methods, including the ODR online dispute resolution platform available at: https://ec.europa.eu/consumers/odr/.

 

§ 8. Liability

  1. The Service Provider exercises due diligence to ensure the proper functioning of the Website.
  2. The Service Provider is not liable for:
  • interruptions in the Website’s operation resulting from technical maintenance or causes beyond the Service Provider’s control,
  • consequences of using the Website in a manner inconsistent with the Terms and Conditions,
  • actions of third parties (hackers, malicious software).

 

§ 9. Personal Data Protection

The rules for processing Service Recipients’ personal data are set out in the Privacy Policy available at https://www.casa-dominicana.com/polityka-prywatnosci/.

 

§ 10. Final Provisions

  1. The Terms and Conditions enter into force on June 1, 2025.
  2. The Service Provider reserves the right to amend the Terms and Conditions. Service Recipients will be notified of changes at least 14 days in advance (via announcement on the website or e-mail). Continued use of the Website constitutes acceptance of the changes.
  3. In matters not regulated by the Terms and Conditions, the provisions of Polish law shall apply, in particular: the Act on the provision of electronic services, the Civil Code, GDPR.
  4. Any disputes shall be resolved by the competent court in accordance with the provisions of the Code of Civil Procedure. For Service Recipients who are consumers, the competent court may be the court of the consumer’s place of residence.
